Welcome to Makia Day ("we," "our," "us"). These Terms of Service ("Terms") govern your use of our website [makiaday.com] ("Website") and the purchase of products from our online store. By accessing or using our Website, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Website.

  1. General Conditions

    1. Eligibility: By using our Website, you represent that you are at least the age of majority in your country or state of residence, or that you have given us your consent to allow any of your minor dependents to use this site.

    2. Changes to Terms: We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our Website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Website following the posting of any changes constitutes acceptance of those changes.

  2. Online Store Terms

    1. Product Information: We strive to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate.

    2. Pricing: Prices for our products are subject to change without notice. We reserve the right to modify or discontinue products without notice at any time.

  3. Orders and Payment

    1. Order Acceptance: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

    2. Payment: All payments must be made through the payment methods provided at checkout. By providing your payment information, you represent and warrant that you have the legal right to use the payment method selected.

  4. Right of Withdrawal

    1. Consumers have the right to withdraw from this contract within 14 days without giving any reason.

    2. The withdrawal period will expire 14 days after the day on which the consumer, or a third party other than the carrier and indicated by the consumer, acquires physical possession of the goods.

    3. To exercise the right of withdrawal, the consumer must inform us of their decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email).

    4. The consumer may use the model withdrawal form provided, but it is not obligatory.

    5. To meet the withdrawal deadline, it is sufficient for the consumer to send their communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

  5. Effects of Withdrawal

    1. If the consumer withdraws from this contract, we shall reimburse all payments received from the consumer, including the costs of delivery (except for the supplementary costs arising if the consumer chose a type of delivery other than the least expensive type of standard delivery offered by us).

    2. We will make the reimbursement without undue delay, and not later than 14 days after the day we are informed about the consumer’s decision to withdraw from this contract. 

    3. We will make the reimbursement using the same means of payment as the consumer used for the initial transaction unless the consumer has expressly agreed otherwise; in any event, the consumer will not incur any fees as a result of such reimbursement. 

    4. We may withhold reimbursement until we have received the goods back or the consumer has supplied evidence of having sent back the goods, whichever is the earliest.

  6. Return of Goods

    1. The consumer shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which the consumer communicates their withdrawal from this contract to us. 

    2. The consumer will bear the direct cost of returning the goods. 

    3. The consumer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

  7. Complaints and Warranty

    1. We provide a 2-year legal warranty on all goods purchased through our store. 

    2. If the goods are defective, the consumer has the right to request repair, replacement, or a price reduction, or to withdraw from the contract. 

    3. Complaints can be submitted via email or by post. The complaint should include the consumer's name, contact details, description of the issue, and proof of purchase. 

    4. We will respond to complaints within 14 days from the day of receiving the complaint. If we do not respond within this period, the complaint is considered to be accepted.

  8. Delivery

    1. We aim to deliver all orders within 3-5 business days, or as specified during the checkout process. 

    2. If we fail to deliver the goods within the specified timeframe, the consumer has the right to set a new deadline for delivery or terminate the contract. 

    3. In the event of contract termination due to non-delivery, we will refund all payments made by the consumer without undue delay.

  9. Price and Payment

    1. All prices displayed on our website include VAT and any other applicable taxes.

    2. The total price, including all related costs, will be displayed before the consumer finalises the purchase.

    3. Any changes in price after the contract has been concluded will not affect the consumer.

  10. Alternative Dispute Resolution

    1. Consumers have the right to use alternative dispute resolution (ADR) methods.

    2. Consumers can access the Online Dispute Resolution (ODR) platform via the following link: [https://ec.europa.eu/consumers/odr].

    3. Any disputes arising out of or in connection with this contract will be governed by Polish law and will be subject to the jurisdiction of Polish courts.

  11. Data Protection

    1. We collect and process personal data in accordance with the General Data Protection Regulation (GDPR) and Polish data protection laws.

    2. Consumers have the right to access, correct, or delete their personal data at any time by contacting us. 

    3. Personal data will only be used for the purpose of fulfilling orders, providing customer service, and complying with legal obligations.

  12. Intellectual Property

    1. Ownership: All content on our Website, including text, graphics, logos, images, and software, is the property of Makia Day or our content suppliers and is protected by international copyright laws.
